1. SCOPE AND ACCEPTANCE
By using this website (the “Site”) and/or purchasing products from Focus Global Inc. (the “Seller,” “we,” “us”), the authorized distributor of Instant Pot in the Philippines, you agree to be bound by these Terms and Conditions. These terms are governed by the laws of the Republic of the Philippines, including the Consumer Act and the Internet Transactions Act.
2. ELIGIBILITY AND ACCOUNT SECURITY
We do not sell products to minors. If you are under 18, you may only use this Site with the involvement of a parent or guardian. You are responsible for maintaining the confidentiality of your account details.
3. PURCHASE TERMS AND PAYMENTS
- Order Acceptance: Your receipt of an order confirmation does not signify our acceptance of your order. We reserve the right to accept or decline your order for reasons such as stock unavailability or errors in pricing.
- Pricing: All prices are quoted in Philippine Pesos (PHP) and are inclusive of VAT unless otherwise stated. Prices may change without prior notice.
- Payment Methods: We accept major credit cards, debit cards, and authorized e-wallets (e.g., GCash, Maya). For Cash on Delivery (COD), the customer must be present at the address to pay the full amount upon arrival of the courier.
4. DELIVERY AND SHIPPING POLICY
- Standard Delivery Timelines: We aim to deliver your orders within the following estimated timeframes after order verification:
- Metro Manila: 1 to 3 business days.
- Greater Manila Area (Bulacan, Cavite, Laguna, Rizal): 3 to 5 business days.
- Luzon (Provincial): 5 to 7 business days.
- Visayas and Mindanao: 7 to 14 business days.
- Delays: Timelines are estimates. Delays caused by force majeure (e.g., typhoons, floods) or courier-related issues are beyond our immediate control, but we will notify you of significant delays.
- Risk of Loss: Under Philippine law, the risk of loss or damage to the goods passes to you only upon actual delivery to the address provided.
5. RETURNS, REFUNDS, AND WARRANTIES
- Returns & Exchanges: We honor all consumer rights mandated by the DTI. While we cannot accept returns for a “change of mind,” all defective goods are eligible for exchange or refund.
- Defective Goods: If your Instant Pot is defective or not as described, you are entitled to a Repair, Replacement, or Refund within the warranty period of 1 year from the date of purchase.
- For newly delivered items that seem defective or are not working as described, kindly attach an uninterrupted unboxing video to your return request to help our team verify the issue instantly, allowing us to process your concern much faster.
All claims for defects are subject to technical inspection by Focus Global Inc.’s authorized service center to determine if the defect is a manufacturing flaw or caused by user misuse (e.g., improper voltage, unauthorized repairs).”
Customers must retain their Official Receipt (OR) or Sales Invoice. This document is required to avail of warranty services at any Focus Global service center.”
- Change of Mind: Please note that “Change of Mind” (Buyer’s Remorse) does not entitle a customer to a refund or exchange under DTI guidelines.
- Cooling-off Period: Pursuant to the Internet Transactions Act, consumers may cancel an order before the items are dispatched for delivery.
6. PRIVACY AND DATA PROTECTION
Our collection of your personal data (name, delivery address, contact number) is governed by the Data Privacy Act of 2012. We use this information solely for order fulfillment and customer support. View our Privacy Policy for details.
7. ANTI-SPAM AND CYBERCRIME COMPLIANCE
We comply with the Cybercrime Prevention Act of 2012 (RA 10175). We do not engage in unsolicited commercial electronic communications (Spam). You may opt-out of marketing emails at any time.
8. LIMITATION OF LIABILITY
Focus Global Inc. shall not be liable for any indirect or consequential damages arising from the use of the products, except as mandated by the Philippine Consumer Act regarding product liability and manufacturer warranties.
9. DISPUTE RESOLUTION
Should a dispute arise, we encourage reaching out to our customer service team first. If an amicable settlement is not reached, disputes shall be resolved through the Philippine Dispute Resolution Center, Inc. (PDRCI) or via the DTI’s Consumer Care mediation process.
